Health care entities have to know and understand who has the legal right to speak for patients, which means understanding the legal definition of when a patient lacks capacity. This talk educates health care providers on these legal standards as well as outlining best practices in handling these issues. The intent is to think through and plan for the real world ways these issues come up in practice. In addition, the talk will provide guidance for comprehensive plans and policies and procedures to aid practitioners and to protect health care providers in terms of legal compliance.
